How this SEPP compliance calculator works
Housing SEPP 2021 (formerly the Affordable Rental Housing SEPP 2009) is the NSW planning instrument that makes boarding houses permissible in residential and certain business zones, sets minimum room sizes and on-site manager thresholds, and grants FSR and height bonuses in exchange for affordability commitments. The instrument is not council-specific — it overrides the standard LEP in zones where it applies — but each LGA still controls Section 7.11/7.12 contributions, traffic study requirements and SEPP70 affordable housing local provisions. The calculator above runs your site’s zoning against current SEPP 2021 controls and surfaces the buildable room count, indicative construction cost and projected gross rental yield.
How the model handles compliance. Zoning is the first gate — boarding houses are permissible with consent in R1, R2, R3, R4, B1, B2 and B4 zones, with R2 capped at 12 rooms in most LGAs and R3 capped at 20. The model takes your site area and zone, applies the relevant FSR (Floor Space Ratio) under the LEP, deducts car parking and amenity space, and back-calculates how many compliant 12sqm-plus rooms fit. Build cost uses 2026 Western Sydney rates of $2,000–$3,100 per m² (lower per-m² than custom homes because rooms are repeating modules), plus DA-specific costs for fire engineering, accessibility (15% of rooms must be wheelchair-accessible) and on-site manager amenity for 12+ rooms.
What the calculator doesn’t do. It doesn’t replace a town planner’s due diligence on site-specific overlays (flood, bushfire, contaminated land, heritage), it doesn’t model commercial finance structure, and it doesn’t guarantee council will approve at the room count the SEPP technically permits — in practice some councils negotiate down through merit assessment. Use it for first-pass triage: does the site stack up at all, and what’s the ballpark return if it does? If the result looks viable, the next step is a paid town planner report before any DA spend.
